As an external NGO member on your IC panel, the scope of work which will be handled by me is as follows:

• My name will be printed on the policy and notifications which are widely circulated / publicised among the employees at all offices along with my contact details. This enables any employee to contact me as a neutral party whenever required and I am bound to respond to them appropriately. I shall respond to the complaints and would be ready to conduct the investigation whether onsite or virtually within 48 hours ( 2 working days) of the receipt of the complaint.
• I will be part of the quorum which conducts investigations into any complaint of sexual harassment from inception till the conclusion and steer the proceedings in accordance with legal guidelines and rules. This will include advising the IC on how proceedings are to be conducted, evidence is to be recorded, appraisal of evidence and drafting of the report from a legal perspective.
• At each stage of the proceedings, all emails which are drafted by way of communication by the IC to the parties/ witnesses will be done by me. Hence, the records of proceedings are drawn up tightfistedly and kept complete.
• I shall guide the IC to reach and submit recommendations which are to be made to the management at the end of the enquiry.
• Based on the conclusions reached by the IC, I will draft the settlement/ enquiry reports from a legal viewpoint so that the same withstand court scrutiny if the matter is ever raised in appeal.

If a company does not empanel an External NGO member on its IC, then the IC is not properly constituted and will not be considered legitimate. It could also invite non-compliance related actions from the government against the said organisation.
